Brainery
Terms of use.
These terms cover your use of Brainery, a puzzle game made by ARA Labs (“we”, “us”). They are short on purpose. Please read them together with our Privacy Policy, which explains what data the app handles.
Accepting these terms
By downloading, installing or playing Brainery you agree to these terms. If you do not agree, please do not use the app. If you are under the age at which you can agree to terms like these where you live, a parent or guardian should read them and agree on your behalf.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to install Brainery on devices you own or control and to play it for your own non-commercial enjoyment. The game, its puzzles, artwork, sounds and code belong to us or to our licensors. You may not copy, sell, rent, redistribute or modify the app or its puzzles, or reverse-engineer it, except where the law allows you to regardless of these terms.
If you got Brainery from the App Store, Apple's standard Licensed Application End User License Agreement also applies. Apple is not responsible for the app or for supporting it.
Free to play, with ads
Brainery is free to download. Players who do not own the upgrade below may see ads from Google AdMob, as described in the Privacy Policy. Ads are provided by third parties; if you tap one, what happens next is governed by that advertiser and not by us.
The Ad-Free purchase
Brainery offers one optional, one-time purchase, Ad-Free + Unlimited Hints. It is not a subscription. Its unlimited hints apply to Campaign and Daily puzzles; competitive modes keep their normal hint limits.
- The store handles the payment. Purchases are made through Google Play or the App Store, under their terms, and the price is the one the store shows you. We never see your payment details.
- Refunds follow the store's policy. Refund requests are handled by Google Play or Apple under their own refund policies, through your store account. If a purchase is refunded, the upgrade may be removed.
- Restoring. If you reinstall or change devices, use Restore Purchases in the app with the same store account. We will try to make restoring work, but we cannot promise that it will in every case.
Nothing in these terms takes away any right to a refund or remedy that consumer law where you live gives you.
Your saved progress
Your progress, scores and settings are saved on your device, not on our servers. We cannot see them or restore them for you. Uninstalling the app or clearing its data can delete them.
Live Friend Race
Live Friend Race is an optional online mode for racing a friend with a private room code. When you use it:
- Choose a decent display name. Your display name is shown to the other player. It must not be offensive, hateful, sexual, threatening or harassing, must not pretend to be someone else, and must not contain anyone's personal details — including your own real name, if you would rather not share it.
- Play fair. Do not cheat, use bots or automated tools, try to disrupt other players' races, or try to break, overload or gain unauthorised access to our game servers.
- Share codes with people you know. Room codes are meant to be shared privately with friends.
We may end a race, or block access to Live Friend Race, if it is used in a way that breaks these rules or puts other players or the service at risk.
Changes to the game
We keep improving Brainery, so puzzles, modes and features can change, and some may be added, paused or removed. Online features need our servers and may occasionally be unavailable.
No warranty
Brainery is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be error-free, uninterrupted or suitable for any particular purpose, and we disclaim all implied warranties.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost progress or data, arising from your use of Brainery, and our total liability to you for anything relating to the app is limited to the amount you paid for the Ad-Free purchase in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or your statutory rights as a consumer.
Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. If a change is significant, we will let you know in the app or on this page. If you keep playing after a change, the updated terms apply.
Governing law
These terms are governed by the laws of India, and disputes about them will be handled by the courts of India. If you live elsewhere, you also keep any protections that the mandatory consumer law of your country gives you.
