Swim Away
Terms of use.
These terms cover your use of Swim Away, a puzzle game made by ARA Labs ("we", "us"). They are short on purpose. Please read them together with our Privacy Policy, which explains what data the game handles.
Accepting these terms
By downloading, installing or playing Swim Away you agree to these terms. If you do not agree, please do not use the game. If you are under the age at which you can agree to terms like these where you live, a parent or guardian should read them and agree for you.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to install Swim Away on devices you own or control and to play it for your own non-commercial enjoyment. The game, its ponds, artwork, sounds and code belong to us or our licensors.
You may not copy, sell, rent, redistribute or modify the game, or reverse-engineer it, except where the law allows you to regardless of these terms.
Free to play, with ads
Swim Away is free to download and shows ads, as described in the Privacy Policy. Ads are provided by third parties. If you tap one, what happens next is governed by that advertiser, not by us.
Purchases
Swim Away offers optional purchases through Google Play:
- No Ads is a one-time purchase that removes the ads between ponds. Videos you choose to watch for rewards stay available.
- Starter Pack is a one-time bundle of coins, helpers and an hour of unlimited hearts.
- Coin packs add coins to your game.
The rules for all of them:
- The store handles payment. Purchases are made through Google Play, under its terms, at the price it shows you. We never see your payment details.
- Refunds follow Google Play's policy and are requested through your Google account. If a purchase is refunded, what it gave may be removed.
- Restoring. No Ads can be restored with Restore purchases, using the same Google account. The Starter Pack and coin packs are added to your game when you buy them and cannot be restored.
Nothing in these terms takes away a right to a refund or remedy that consumer law where you live gives you.
Coins, hearts and helpers
Coins, hearts, helpers and other things in the game are part of the game. They:
- are not money and have no cash value;
- can't be exchanged for money or anything outside the game;
- can't be transferred to another player.
We may change how they work, for example prices in coins or how hearts refill, to keep the game balanced.
Your saved progress
Your progress, coins and settings are saved on your phone, not on our servers. We cannot see them or restore them for you. Uninstalling the game or clearing its data can delete them, including coins you bought. If your phone's backup to your Google account is on, Android may bring them back on a new phone.
Changes to the game
We keep improving Swim Away, so ponds, helpers and features can change, and some may be added, paused or removed. Some settings, such as how often the ad between ponds may appear, can change without an app update; the game picks up a change the next time you open it.
No warranty
Swim Away is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be error-free, uninterrupted or suitable for any particular purpose, and we disclaim all implied warranties.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost progress or data, arising from your use of Swim Away. Our total liability to you for anything relating to the game is limited to the amount you paid for purchases in it in the twelve months before the claim.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or your statutory rights as a consumer.
Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. If a change is significant, we will let you know in the game or on this page. If you keep playing after a change, the updated terms apply.
Governing law
These terms are governed by the laws of India, and disputes about them will be handled by the courts of India. If you live elsewhere, you also keep any protections that the mandatory consumer law of your country gives you.
